By completing the booking of this course you acknowledge and agree to the terms and conditions below.

 

Safety is paramount

In addition to enjoyment and learning new skills, safety is of paramount importance on all of the Club’s courses.

 

Risks and voluntary participation

You understand that the participation in water sports, sailing or boating activities has inherent risks.  Risks include overexertion, equipment failure, dehydration, serious accidents, weather conditions, water quality, shark attack, and stings, which may result in you or your child being injured or your property being damaged.  After considering the risks involved, you have voluntarily decided to participate or allow your child to participate in the course and assume all potential risks.

 

Health and safety measures

The Club will perform its services with reasonable skill and care, and implement robust health and safety measures to address all reasonable and foreseeable risks with qualified staff, training, protective and safety equipment, guided by rigorous policies and procedures which are reviewed on a regular basis.

Compliance with instructions and regulations

You or your child must comply with all reasonable and necessary instructions given by Club staff in relation to the course(s) in which you or your child participates.

You or your child must abide by the health and safety policies and procedures of the Club, including its COVID-19 regulations, as may be revised and updated from time to time.  The latest Club policies and regulations are available at www.abclubhk.com

 

Medical and physical fitness

You declare that you or your child is, and must continue to be, medically and physically fit and able to participate in the course.  Should you or your child suffer from or become aware of any illness and/or require medical attention for a pre-existing condition, you will fully disclose all details to the Club so that you or your child is not a danger to yourself or to the health and safety of others.  It is important that you notify the Club of any medical condition that may be relevant to you or your child’s participation in the course and any medication you or your child may need.  You will also immediately notify the Club in writing of any change to your or your child’s fitness, health and ability to participate in the course. You understand and accept that except if you advise otherwise in writing, the Club will rely upon this acknowledgment as evidence of your or your child’s fitness and ability to participate in the course.

 

Payment

Club Members shall be charged through their Club account. Children of Club members must be registered as members with the Club membership office to enjoy the members’ course fee. All other applications will be charged via the online payment system. Please ensure you select the correct course fee (Club member or non-member).

 

Cancellation or modification of course

If you cancel your booking more than one month before the first scheduled day of the course then 50% of course fee will be refunded. There will be no refund if you cancel within one month of the start of the course.

We reserve the right to modify or cancel a course if there are insufficient students or if we feel that there are unmanageable and unacceptable risks to you, our staff or any third party.  You will receive a full refund in the event of such a cancellation by the Club.

Courses cancelled by the Club due to inclement weather will be rescheduled or refunded at the discretion of the Club.

 

Indemnity

You acknowledge that participation in the course is your personal decision after having considered the course, regulations and risks, and agree in consideration of the acceptance of your enrolment, to indemnify and hold harmless the Club from and against any Claim that you or any other person, including your relatives or any other participant in the course, may have in connection to the occurrence of any risk, damage or injury (excluding personal injury or death caused by negligence) you or your child may suffer or cause arising out of participation in the course. “Claim” means and includes any action, suit, proceeding, claim, demand, damage, penalty, cost or expense however arising (whether in tort, including negligence, contract, statute or otherwise).

 

Inclement Weather

Courses will be cancelled if a Typhoon Signal No 3 is raised or a Red or Black Rainstorm warning is in force 1.5 hour before the course start time. The course will still go ahead if the Typhoon Signal No 1 or Thunderstorm Warning is issued, but on the water activities will of course not take place if there are any thunderstorms in the local area.

Photos and Video

You acknowledge that ABC may photograph or video participants sailing, and you agree that such photographs or video may be taken, and on occasion used to promote Club courses and sailing activities.

The Club reserves the right to update these terms and conditions from time to time.
